Rosemary S. Gousman, Regional Managing Partner
Rosemary Gousman is the managing partner of the firm’s New Jersey office and the co-chair of the Financial Services Industry Group. She has devoted her extensive career to the practice of labor and employment law.
Rosemary’s diverse practice includes both litigation and counseling of employers. She litigates cases involving discrimination, wrongful discharge, whistleblower claims, wage and hour laws, common law contract and tort claims, traditional labor law involving union-management relations, and employee benefits disputes. Rosemary has significant trial experience in bench and jury trials, as well as arbitration proceedings, including Financial Industry Regulatory Authority (FINRA). She has appeared before a variety state and federal administrative agencies.
Along with her litigation work, Rosemary counsels clients on the appropriate handling of disciplinary matters, employee terminations, compliance with employment statutes and state and federal regulations dealing with harassment and discrimination, wages and leaves of absence. She regularly advises employers on employment contracts and corporate policies on wide-ranging topics such as performance management, discrimination and harassment complaints, disability and Family and Medical Leave Act (FMLA) leave management, pre-employment screening, and reductions in force.
Rosemary has served as lead counsel on a number of jury trials, and has obtained summary judgment in a number of discrimination, retaliation, public policy and common law claims in favor of her clients.
Rosemary lectures frequently on various topics in employment law, including discrimination, sexual harassment, Americans with Disabilities Act (ADA), Family and Medical Leave Act (FMLA), internal and Equal Employment Opportunity Commission (EEOC) investigations, and workplace privacy and social media both for her clients, attorneys, and industry groups.
Pauline M.K. Young, Member
Pauline M.K. (Kohl) Young is a member of the firm at McLaughlin & Nardi, LLC. Pauline brings a unique mix of intelligence, discretion, diligence and street smarts to our firm. Pauline handles a wide range of matters including litigation, real estate, business formations and transactions, employment law, and collections law. Pauline aids individuals and businesses by providing personalized services to fit the unique needs of each client.
Pauline has significant litigation experience including trials, arbitration, and mediation. For instance, Pauline recently handled a jury trial and obtained a successful verdict in a contract dispute between two garbage/recycling companies and successfully mediated several employment cases. She has conducted trials, arbitrations and mediation.
Pauline represents employers and employees and businesses in employment related matters, including whistleblower protections such as the Conscientious Employee Protection Act, New Jersey’s Law Against Discrimination, anti-retaliation laws, Woolley claims for breach of employee handbooks, hostile work environment scenarios, sexual harassment, violations of the Fair Labor Standards Act, and New Jersey’s Wage and Hour Law violations.
Pauline also represents clients in commercial litigation involving various claims from contract and partnership disputes, to tortious interference and fraud. Through her commercial litigation experience, she has become skilled at digging through voluminous financial and business records to understand the crux of each matter to better aid and advise her clients.
Pauline also handles complex commercial and real estate transactions. Pauline is also experienced with drafting and reviewing contracts in various transactional matters from employment related contracts to leases and residential real estate matters. She recently merged her contract and real estate practices together in a matter where she helped a manufacturer negotiate a contract resolving bad debt and then negotiated a contract for and handled the closing of the sale of its equipment and real estate.
Pauline is admitted to the bars of New Jersey and New York. She is also admitted to practice in the Federal District Courts of New York and New Jersey and the Third Circuit Court of Appeals.
Pauline has significant experience in the solid waste industry, including litigation, transactions and A-901 applications and transfers.
Pauline previously worked at New Jersey’s Division of Consumer Affairs, New Jersey’s governmental agency which regulates professionals such as lawyers, doctors, and accountants; regulates consumer industries such as home construction and automobile sales; investigates and prosecutes consumer complaints; and regulates securities transactions in New Jersey. She also previously worked for a large retail collections law firm representing major creditors of consumer debt. Pauline began her tenure with the firm as a law clerk while she was still in law school, and lucky for us she came back after she graduated.
Pauline is a graduate of the American Inns of Court, Richard J. Hughes Chapter, which conducts graduate level trial advocacy training for select young attorneys run by respected judges and senior practitioners. She also continues to complete courses on various legal updates and changes in the areas of real estate, commercial litigation, and employment law.
Pauline received her juris doctorate from New York Law School. Pauline received her bachelor’s degree in political science with a minor in law from Montclair State University, summa cum laude, where she was part of the Honors Program and graduated a semester early. Pauline served as President of Montclair State’s chapter of Pi Sigma Alpha, the National Political Science Honor Society, where she organized and chaired numerous academic events. Pauline received the Dean’s Award for contributions to Montclair State’s College of Humanities and Social Sciences and was also a disc jockey at 90.3, WMSC.
